Q. Is my employer required to offer me severance pay ?
A. No. Generally, except for very limited circumstances, there is no legal obligation for employers to provide severance pay to separating employees. Unless there a contract between the employer and employee that requires severance pay or a company policy or practice that would require severance pay, generally employees are not entitled to any severance pay. That being said, in an effort to reduce any potential legal exposure, many employers voluntarily decide to offer severance package in exchange for a signed release of claims against the employer.Q. Do I need to have an experienced employment lawyer review my separation package before signing it?
A. Yes. It is advisable to have a trained employment lawyer counsel you on your rights before signing a severance agreement. When you execute a severance contract, most likely you are waiving your rights to bring a claim and, at times, in addition, agreeing to terms which could limit your future career prospects. For example, many employers will not only ask you to release any and all claims against the company but also agree to broad one-sided confidentiality, non-disparagement and cooperation clauses. Furthermore, some employers try to add in non-competition and non-solicitation obligations that could significantly hinder your ability to find new employment. Our experienced New York, New Jersey and Connecticut Severance Pay Package Attorneys will review the factual circumstances surrounding your termination, evaluate the strength and weaknesses of the legal basis of any employment-based claims, explain the terms of the severance agreement with you (including the reasonableness of each paragraph) and, if requested, negotiate your severance package to ensure that you received the maximum amount of compensation and benefits. Your ability to maximize your severance pay is crucial in this economic climate when many experienced employees face a period of unemployment with no income and a potential loss of health insurance benefits. Our Severance Agreement Attorneys will work closely with you to protect your rights in the workplace. Call now to speak with one of our Severance Lawyers at (800) 893-9645.
